PRIVACY POLICY
- Purpose
By using this website and/or communicating electronically with The Captains Council Inc. (hereinafter referred to as “TCC”), personal data of each User may be collected and processed, the treatment of which is governed by this privacy policy (“Privacy Policy”). All capitalized terms in this Privacy Policy shall have the meaning set forth in the Terms of Use unless expressly defined in this Privacy Policy.
- Data Controller
The entity responsible for processing the personal data provided by the User through the Website and Applications is TCC, with its registered office at the address mentioned on the main webpage. Any inquiries regarding this can be communicated via the following email: info@captainscouncil.org
- Data Collected
The types of personal data collected and processed from Users on the website and Applications are as follows:
- IP Address, Cookies, and Similar Technologies. The IP address is a code that identifies the User’s internet connection at a specific moment, and Cookies are files downloaded to the User’s browser that can later be read by the website.
- However, it is not possible to determine the User’s identity with this data unless additional information is provided through other means.
- Subscription to our newsletters and/or publications. The collected data will include the necessary identifying details to deliver the content to which the User has subscribed.
- Subscription to events and similar activities. The collected data will include the necessary identifying details to manage participation, such as name, surname, email, company, job title, and professional contact details. Additionally, these events may be broadcast live in their entirety, photographed, and/or recorded. Consequently, in such cases, the User’s image may be published through TCC’s internal and external communication channels, as well as in online environments (website, social media, digital platforms, etc.), solely for the purpose of reporting on the Firm’s activities. By registering for the event, the User acknowledges and accepts these terms.
- Purposes of Data Processing
Users’ personal data will be collected and processed to manage the relationship with TCC, including event registration and/or newsletter subscriptions, as a point of contact for the aforementioned Association, to manage website usage, and, where permitted by applicable regulations, for the recurring distribution of legal information or educational and outreach events related to professional activities promoted by TCC. Additionally, personal data will be collected and processed to respond to inquiries or questions submitted through the Website.
- Legal Basis and Retention
The legal basis for processing the IP address is the necessity of enabling the internet connection to the website, as well as TCC’s legitimate interest in maintaining the relationship with the User and sending legal information and details of the Firm’s activities.
For newsletter and/or event subscriptions, as well as User requests for information or specific services, the legal basis will be the User’s consent.
TCC will collect and process data as long as the relationship remains in effect and, if applicable, until the User withdraws consent for data processing. In any case, once personal data is no longer required for the purpose for which it was collected, and as long as legal or contractual obligations require its retention, the data will be stored in a restricted manner until its final deletion.
For communications, data may be retained until the User objects to receiving such communications through any of the available means.
- Disclosure of Data
TCC will not disclose User data to third parties unless it is strictly necessary to manage and maintain the relationship with TCC or if prior authorization is granted by the User. Specifically, only third parties with whom TCC is legally or contractually required to share data will have access to personal information.
Additionally, as a law firm with an international presence, if necessary for service provision, TCC may share Users’ data with its affiliated companies, as detailed in the provided link, for the same purposes mentioned above.
In cases where Users register for TCC-organized events, either independently or in collaboration with third parties, their data may be shared with such third parties solely for the purposes of organizing and managing the events.
- User Rights
Users are informed that they have the right to exercise, at any time and under the terms established by current legislation, their rights of access, rectification, or deletion of data, as well as the right to request limitations on processing, object to processing, request data portability, and withdraw previously given consent. Such requests should be made in writing to the Association’s registered address or via the previously mentioned email address, clearly indicating the right being exercised and attaching an identity document, passport, or similar identification document verifying their identity.
If Users provide personal data of third parties, they guarantee that they have informed such individuals beforehand of the contents of this Privacy Policy and will be personally liable to TCC for any damages or legal consequences arising from non-compliance.
Users commit to notifying any changes or modifications to the personal data they have provided. Any loss or damage caused to the website, TCC, or any third party due to the communication of incorrect, inaccurate, or incomplete information will be the sole responsibility of the User.
