Terms of Use
- INTRODUCTION
The Captains Council, Inc. (hereinafter referred to as “TCC”) is a non-profit association duly incorporated under the laws of the Dominican Republic.
TCC holds all intellectual property rights or any other rights over the website (hereinafter, the “Website”), whose access and use by users (hereinafter, “User” or “Users”) are subject to these terms of use (hereinafter, “Terms of Use”) and are supplemented by any other legal texts regulating any functionality, service, process, application, platform, or means necessary for the use of the Website.
By accessing the Website and using the materials contained therein, you acknowledge that you have read and fully accept these Terms of Use without any reservations. If you do not agree with all or part of these Terms of Use, you must refrain from using the Website.
- PURPOSE
The Website contains material prepared by TCC for informational purposes and also serves as a communication channel with its current and future members. Additionally, TCC reserves the right to modify, expand, or reduce the material offered through the Website at any time, notifying Users accordingly.
The material contained on the Website should not, under any circumstances, serve as a substitute for legal or other professional advice. Users should not act based on the information provided without first seeking appropriate professional guidance.
In this regard, and without prejudice to the provisions of the preceding paragraphs, TCC grants Users a non-exclusive, non-sublicensable, and non-transferable license to use the Website.
- USER COMMITMENTS
In general, the User agrees to comply with these Terms of Use, as well as any special warnings or instructions contained therein, always acting in accordance with applicable law, morality, good customs, good faith, and public order. The User shall exercise due diligence and refrain from using the Website in any way that may impede, damage, or deteriorate its normal functioning, the property or rights of TCC, other Users, or any third party.
Specifically, and without limiting the generality of the foregoing, the User agrees to:
- Provide truthful information regarding the data requested in the forms provided by TCC for access to certain content or services offered through the Website and to keep them updated. TCC reserves the right, without prejudice to other legal measures available, to withdraw, deny, or suspend access to the Website if the data provided is found to be false, inaccurate, or misleading. In any case, the User is fully responsible for the data or content transmitted or communicated to TCC. The User assumes liability for any damages that may arise from improper use of such information.
- Not introduce, store, or disseminate through the Website any program, data, virus, code, or any other electronic or physical device that may cause damage to the Website, its services, or any of TCC’s equipment, systems, or networks, or those of any other User or third party.
- Not alter, copy, download, modify, decompile, disassemble, reverse engineer, license, lease, sell, or imitate the Website and its contents.
- Not introduce, store, or disseminate through the Applications any content that infringes third-party industrial and/or intellectual property rights or trade secrets, or any content that the User is not legally authorized to share.
- LIABILITIES AND WARRANTIES
TCC shall not be held liable for damages that may result from interferences, omissions, interruptions, computer viruses, malfunctions, and/or disconnections in the electronic system or in Users’ computers, caused by factors beyond TCC’s control that may impede or delay browsing the Website. Additionally, TCC shall not be liable for delays or service disruptions caused by deficiencies or overloads in the Internet or other electronic systems, nor for the inability to provide service or allow access due to causes beyond TCC’s control, including those attributable to the User, third parties, or force majeure.
However, TCC declares that it has adopted and will adopt all necessary measures, within its capabilities and the state of technology, to ensure the proper functioning of the Website and to prevent the presence and transmission of viruses and other harmful components to Users.
TCC reserves the right to interrupt access to the Website at any time and without prior notice for technical, security, control, maintenance, power supply failure, or other reasons. TCC does not generally monitor Users’ usage of the Website.
TCC is not responsible for any use that the User may make of the Website’s content, which may constitute a violation of national or international regulations, intellectual or industrial property rights, or any other rights of third parties.
TCC does not guarantee the absence of viruses or other harmful elements that may cause damage or alterations to the User’s computer system, electronic documents, or files. Consequently, TCC is not responsible for any damages these elements may cause to the User or third parties.
- INTELLECTUAL AND INDUSTRIAL PROPERTY
All intellectual and industrial property rights, as well as all information contained on the Website (including, but not limited to, information, texts, data, images, graphics, designs, source code, software, trademarks, navigation structures, databases, and any other content appearing therein), are the exclusive property of TCC.
TCC grants Users a non-exclusive, non-sublicensable, and non-transferable license to use the Website, subject to these Terms of Use and any other applicable legal terms. Users are authorized solely to view and obtain a temporary private copy of the contents for personal and private use on their computer systems (software and hardware), but they are not authorized to transfer them to third parties. Users may not modify or reproduce the information, either in part or in whole, without TCC’s express written consent.
These Terms of Use do not transfer any intellectual or industrial property rights, including copyright, trademarks, designs, or other rights, except for the limited license granted to Users for the use of the Applications under these terms.
- DATA PROTECTION
TCC will protect Users’ personal data and use them only to the extent permitted by law or when Users have given their consent. Users can find more information in the Privacy Policy.
- THIRD-PARTY LINKS
These Terms of Use apply only to the Website and TCC’s content and do not apply to links, websites, or any services provided by third parties. TCC does not control the information, content, products, or services provided by third parties that may be linked to the Website, nor does it imply that TCC recommends or approves such content.
TCC assumes no liability for third-party content accessed through links from the Website. If Users access other networks or resources, they agree to be subject to their corresponding terms of use and privacy policies.
TCC provides Users with these links and information/services solely for their convenience. Their inclusion does not imply TCC’s approval of the linked website.
- MODIFICATIONS TO THE TERMS OF USE
TCC reserves the right to modify or update these Terms of Use at any time, as well as any information that may appear on the Website.

For the purposes of these Terms of Use and any necessary communication between the User and TCC, Users must contact info@captainscouncil.org.
- REPORTING INCIDENTS AND POSSIBLE VIOLATIONS
TCC respects third-party rights and applicable laws. Users are also required to do so. If Users encounter technical issues with the Website or find errors, inaccuracies, or content that violates laws, they may contact info@captainscouncil.org.
- SEVERABILITY AND INTEGRATION OF CLAUSES
If any clause in these Terms of Use is deemed unlawful, invalid, or unenforceable, the remaining provisions shall remain effective, provided that the rights and obligations of the parties are not fundamentally affected. The affected clause shall be replaced with a legally valid provision that aligns with its purpose.
- GOVERNING LAW AND JURISDICTION
Access to the Website implies acceptance of these Terms of Use by the User. If you do not agree, please refrain from visiting or using the Website. Any disputes relating to these terms shall be governed by Dominican law, with the parties expressly waiving their jurisdiction and submitting to the courts of the United States of America.
